We frequently draft, review, revise and negotiate construction agreements, including professional service agreements. Our goal is always to obtain a fair agreement that achieves the appropriate balance between the parties to the contract. We understand that it is not always possible to negotiate the perfect contract, but we assist the client in obtaining the best possible agreement and educate the client so that the client can make an informed business decision.

Lenders and other third parties often ask construction professionals to execute certifications, consent to assignment documents, lien subordination agreements and other documents relating to the work or services performed on the project. These documents impose upon the construction professional duties, obligations and liabilities beyond those that should be undertaken.  We review and negotiate documents that protect the interests of our clients while providing reasonable and appropriate documentation for the requesting party.
